Ex-con charged with fatally shooting dad holding baby
An ex-con has been charged in the slaying of a Bronx dad who was fatally shot while cradling his baby girl in his arms, authorities said Tuesday.
James Capers, 22, is accused of being the heartless gunman who ran away laughing after opening fire on Allen McQueen, 21, as he carried daughter Taylor, 1, to a park around 1:30 p.m. on July 7.
The tot fell to the ground, crying and covered in blood, following the broad-daylight attack, which Police Commissioner Bill Bratton blamed on a gang-related dispute.
An aunt called it a “miracle” that Taylor survived the hail of bullets that killed her dad, who cops said was struck by one of three rounds fired at him.
McQueen had previously survived getting shot last summer.
Capers, who fled the scene in a Mercedes-Benz, was arrested July 15 and has been held without bail since then, according to the Bronx District Attorney’s Office.
He’s charged with second-degree murder, first-degree manslaughter and criminal possession of a weapon.
State prison records show that Capers served a 1-1/2 year sentence for a Bronx drug conviction before being sprung from the slammer in December 2011.
His rap sheet includes at least nine other arrests dating back to 2009, sources said.
In addition to Taylor’s killing, Capers is currently facing prosecution for a May 21 robbery and a June 25 weapon-possession case.
Before his death, McQueen was busted about 20 times, on charges including attempted murder and robbery.
