New rules for employees who get sick while on vacation:
Workers who fall sick while on holiday will be able to demand extra time off under an EU ruling which has been branded a malingerers' charter.
The move was immediately condemned by employers in Britain, who said it would be 'open to abuse' by unscrupulous staff who simply wanted to extend their break.
It effectively means employees who become ill while on leave would be able to demand extra paid holiday to compensate them, according to employment lawyers.
The ruling by the European Court of Justice, in Luxembourg, will apply in British courts with immediate effect.
A spokesman for the Federation of Small Businesses described it as 'a potential nightmare for employers'.
He added: 'This could have an enormous impact on small businesses at what is already a very difficult time.
'We will have to wait for the details, but it is hard to see how it will be anything other than another burden on small business.'
