Of course this is what the State Attorney's office in Baltimore decides to do after the Acorn employees were found to be aiding and abetting in prostitution and human trafficking. They decide to prosecute the whisteblowers:
STATEMENT OF STATE’S
Baltimore, MD – September 11, 2009 – We have received inquiries from citizens and the media asking whether the Baltimore City State’s Attorneys Office would initiate a criminal investigation for acts allegedly committed at ACORN offices located in Baltimore. The only information received in reference to this alleged criminal behavior was a YouTube video. Upon review by this office, the video appears to be incomplete. In addition, the audio portion could possibly have been obtained in violation of Maryland Law, Annotated Code of
If it is determined that the audio portion now being heard on YouTube was illegally obtained, it is also illegal under Maryland Law to willfully use or willfully disclose the content of said audio. The penalty for the unlawful interception, disclosure or use of it is a felony punishable up to 5 years.

Do you remember the people in Florida with the scanner who illegally intercepted a phone call between Newt and another Republican and then sent the tape to a Congresman who sent it to the NY Times? They were never prosecuted.
What you want consistency? How about all the outrage you have heard about that pro-lifer who was murdered? Oh wait...
It's funny, according to http://biggovernment.com/2009/09/15/exclusive-acorn-illegally-operating-in-maryland/ Acorn wasn't even licensed to operate in the state of Maryland. I think the State Attorney is going to be investigating more than the wiretapping.
