Federal appeals court rules against ACORN

A federal appeals court has overturned a lower court decision that prevented Congress from withholding funds from ACORN. According to the Associated Press, “The ruling Friday reverses a decision by a district court. That judge found Congress had violated ACORN’s rights by punishing it without a trial.”
In March, U.S. District Judge Nina Gershon in New York ruled that Congress had no authority to deny funding to to the scandal-ridden ACORN organization. It was a bizarre decision, with the judge essentially saying that congress had no right to “punish” ACORN without a trial. The problem here is that if that were the case every group that congress arbitrarily denies money too would suddenly have grounds for a lawsuit. As I characterized the earlier decision, “No matter how grossly illegal the activities an organization is engaged in, they apparently have a constitutional right to your money if an unelected federal judge says so.”
